7Travel Customer Terms and Conditions

Welcome to 7Travel.
The following terms and conditions (‘Terms’) govern the use of the 7Travel website, www.7travel.com.au ('website') and booking services, online and offline, that are provided so that people can make legitimate bookings for flights, hotels, rental cars, tours, activities and other products and services, as well as packages which may bundle one or more of these products (‘7Travel Service’).
All bookings and enquiries must be made through 7Travel by calling 1300 297577 or online at www.7travel.com.au.
Please read the following Terms carefully. We reserve the right to update our Terms from time to time. By using the 7Travel Service you signify your acceptance of the then-current Terms.
The terms "we", "us", "our", and "7Travel", refer to Seven Network (Operations) Limited (ABN 65 052 845 262) ('Seven').
The term "you" refers to any person using the 7Travel Service.
The travel components that make up parts of our 7Travel Service, are supplied by one or more third-party suppliers ('Suppliers'), such as airlines, hotels and cruise companies, and each may have their own conditions that apply to bookings made using the 7Travel Service.
The conditions of use
These Terms apply to everyone who uses the 7Travel Service. By using the 7Travel Service, including purchasing packages and products available via the 7Travel Service, you indicate that you accept the Terms, and agree to be bound by them.
Our Suppliers provide information about their products and services, including pricing. This information can change, and supply can be withdrawn at any time. If this change relates to a booking you have made, then we will contact you as soon as practical to discuss.
Bookings and requests that you make using the 7Travel Service are deemed to be an offer made by you to purchase the relevant travel-related products or services subject to our Terms, as well as the conditions of the relevant Supplier.
By requesting a booking, you agree that we will charge your credit card or payment card for the amount displayed, or provided to you, at the time of booking and that you are responsible for any charges that your bank applies to a transaction.
By completing payment for your booking, you agree that you have entered into an enforceable contract for the 7Travel Service.
Before we finalise your booking, the credit card or payment card holder may be required to submit verification documentation, such as providing a scanned copy of their passport and/or drivers licence.
Either we, or our Suppliers may choose not to accept your booking. Your booking is confirmed as accepted by us when we have sent to you, your finalised Travel Documentation.
You agree that:
- you must be 18 years or older to make a booking;
- We will rely on the authority of the person making the booking to act on behalf of any other traveller on the booking and that person will bind all such travellers to these terms and conditions. The person making the booking has the ultimate authority over the booking, including amendments and cancellations.
- when you make a booking online, you are using software which is owned by or licensed by us;
- information about third-party Supplier products and services, such as ratings and reviews are provided for your benefit and may not be accurate at the time provided;
- travel products and services are subject to availability and can be withdrawn at any time, therefore we do not guarantee the availability of any package displayed on our website;
- we are not responsible for content displayed on third-party websites;
- our website may contain errors that cause it to not operate as intended;
- any information you provide to us is true and accurate;
- we may pre-authorise your credit card or payment card;
- we may charge your credit card or payment card for bookings you request; and
- it is your responsibility to ensure compliance with all regulatory requirements (such as passport validity and visas), and other general travel requirements such as appropriate vaccinations, arriving at the airport on time and ensuring that the travel documents we provide match the names on the corresponding travellers and their documents (such as passport validity and visas).
You agree not to:
- provide us with information relating to any person that you are not permitted to provide;
- use the7Travel Service to make bookings for anyone you are not authorised to act on behalf of;
- use the 7Travel Service for any unlawful or prohibited purpose;
- disassemble or reverse engineer any part of our website; or
- use, reproduce or modify our branding or logos.
All pricing is quoted in Australian Dollars (AUD) unless specifically advised or displayed.
When we provide you with a price that we have obtained in a foreign currency, the price displayed may slightly differ from the price quoted elsewhere on the website. We may round prices quoted on the website to the nearest whole dollar.
Pricing displayed on the website and in 7Travel advertising is:
- per person-twin share, unless otherwise specified ie: Your accommodation sleeps 2 guests, unless stated otherwise. Where necessary extra guests or children will incur a charge for additional bedding and flights where offered. Further details can be provided on request from 7Travel on 1300 297577.
- based on departure from location nominated;
- for valid travel periods only (ie: blockout periods apply);
- subject to availability;
- subject to surcharges; and
- subject to change without notice.
Rates and prices quoted in print or on the website and quoted by our reservations personnel are subject to availability and can be withdrawn or varied without notice. The price is only confirmed when final payment has been received by us. Price changes may occur at any time by reason of matters outside our control which increase the cost of the product or the service provided by the suppliers. Such factors include but are not limited to adverse currency fluctuations, fuel surcharges, price increases made by our suppliers, taxes and airfare increases. Any price increase that is outside our control will be added to your account and is payable no later than 60 days from departure.
Rates and prices do not include any costs incurred en route to and from the destination, meals and/or alcoholic beverages (unless specified), telephone calls, items of a personal nature, and personal services not specified as being included in costs on the relevant web pages for each supplier’s product. Where gratuities are included in the price of a cruise, this refers to cruise gratuities only. On board credit for use on board the ship and amount is per cabin based on twin share.
7travel offers the ability to book your holiday immediately, or to buy a Voucher, which allows you to book your holiday later (within a stipulated period of time).
Where the deal does not offer a Voucher, payment is due at time of booking. Where payment via a deposit and final amount is offered, full payment must be made by the ‘book by’ date listed on each deal page.
Payment can be made by BPAY; Visa or MasterCard (for which a 1.3% credit card surcharge will apply); or Amex (for which a 2.9% credit card surcharge will apply). Bookings can only be confirmed upon receipt of cleared funds.
The amount quoted at the time of booking is the amount that you will be charged.
Packages and Package Value (Deals / Deal Value)
Packages are bookings that include more than one product and service for a combined price. We are not permitted to disclose the component pricing of our packages. What is included in a package, as well as the number of people (adults and children) that the package includes, will be detailed on our website, or advised by us. Additional information, including the conditions provided by the Suppliers can be read in the “fine print” that is displayed with the package information.
You need to pay the Supplier directly for any additional charges that are not specifically noted as included in your package. This includes, but is not limited to, meals, transfers, taxes that must be paid locally, additional bedding, resort fees and minibar.
The ‘valued at’ and comparative savings have been determined based on the hotels full retail rates, non-promotional published airfares and the full retail value of inclusions. Please be advised that dependent on the timing and manner of your booking these rates can change and therefore the ‘valued at’ and comparative savings are only indicative.
Savings '% off' is calculated on the maximum discount across all departure points.
'Valued at' price is based on the maximum price across all departure points.
Supplier Rules and Restrictions
We do not operate the products displayed or supplied via the 7Travel Service. The information displayed is provided to us by the relevant suppliers of the products and services, such as airlines or hotels, and their agents. This includes, but is not limited to, descriptions of services, information about pricing, as well as the rules and restrictions that apply to the booking of the travel products and services. We rely on the accuracy of the information supplied to us.
If we become aware that the information provided by a Supplier is incorrect, we reserve the right to correct this information and, in consultation with you, amend your booking so that it reflects the correct price or otherwise complies with the correct information. Additional charges may be payable by you if you wish to proceed with the impacted booking and these will be advised to you at the time of consultation.
In addition to our Terms, additional conditions may be imposed by the Supplier of the product and services you are booking. You must comply with their conditions. We will advise you of these whenever the supplier provides them to us. Please read the conditions in the “fine print”, even if you have booked before because rules (including if you can cancel and change, if it is refundable etc.) can change at any time and vary based on the fare, rate and package you select. You acknowledge that any violation of any of the relevant Supplier's rules and restrictions may result in the cancellation of your booking and you may forfeit the money paid for the booking. It is your responsibility to comply with any cancellation deadlines of the applicable Suppliers.
Voucher booking process
If your offer is available with a Voucher, it is valid for the period as specified for each offer as outlined on the 7Travel website, in which time you will be required to book your holiday (remember, the quicker you are the more likely it is that you will receive your preferred travel dates). Your voucher cannot be used and will not be honoured past the dates detailed on www.7travel.com.au, unless express written consent is received from us. If you have not booked your holiday before the expiry date of your Voucher, the Voucher will automatically lapse and you will no longer be entitled to book a holiday. Once your Voucher has expired your Voucher is non-refundable. You agree that you will not have any claim against us if this occurs.
Upon purchase of your Voucher, you will receive an email with your receipt number and Voucher code. You will need these to make a booking. All deal inclusions must be redeemed in a single visit (unless specified otherwise) I.e if you purchase a 7 night deal you must take all 7 nights consecutively.
When you contact us to make your booking, we will endeavour to book and confirm all components of your package within 72 hours of receiving your booking details. Should we not be able to confirm any component we will contact you with an alternative within 72 hours.
Your Voucher cannot be used in conjunction with any other offer or promotion available through 7Travel and/or participating suppliers.
Your Voucher is not transferable and cannot be used to gain financial advantage through being sold, scalped, auctioned, raffled, pledged, redeemed for cash, or promoted as an incentive or reward by any third party as an inducement for any person or other entity to enter into any commercial arrangements with a third party. If your Voucher has been obtained through any of these methods, it will not be honoured.
Availability of accommodation is displayed on the 7Travel website, www.7travel.com.au. Your booking is subject to the availability of the actual rooms provided by the resort and/or seats provided by the participating airline. Some packages utilise low cost airlines and the package price is reliant on us booking a specific promotional fare and is only confirmed upon receipt of confirmation to us from the Supplier(s). Should this not be available, or the traveller wishes to secure an alternative flight or airline, any difference in price must be paid by the traveller. Each promotional offer is limited to a certain number of customers. We secure more than the required allocation of rooms and airline seats (where full service airlines are used) for each promotional offer, however there is no certainty that your preferred rooms and airline seats will be available on any given day. You acknowledge that booking available rooms and airline seats is on a "first come first served" basis. Please visit www.7travel.com.au to make your own enquiries about current availability. You agree that you shall have no claim against us if your preferred dates are not available.
Once full payment is made, if you cancel for any reason, subject to below* you will not be entitled to any refund, including any extras purchased. If you believe there are compassionate or other extenuating circumstances as to why you have cancelled your holiday, please advise us and we may, in our absolute discretion, offer you an ex gratia partial refund. In the limited circumstances where you are not able to proceed with your booked holiday as a result of the insolvency of a service provider, we will refund to you any amount which you have paid to us and which we have not already paid (or are not legally obliged to pay) on your behalf to service providers. In that case, you agree that we shall be entitled to retain a booking fee applicable to your booking (a minimum of $200 per person) which is a reasonable remuneration for the services that we have provided and is a reasonable estimate of the expenses incurred by us in advertising, facilitating and booking your holiday.
*Vouchers - In the unusual event that your preferred travel dates are not available and within 14 days of purchase but prior to the specific deal book by date, your voucher will be refunded. Outside 14 days from purchase or after the specific deal book by date no refund applies. Refunds will not be granted once accommodation and flights have been confirmed.
Should you default in making any payment in accordance with the agreed trading terms, then all monies owing to 7travel shall immediately become due and payable. We shall be entitled to charge interest at the rate of 3% above the 90 day bank bill rate as set by The Reserve Bank of Australia per calendar month on all overdue amounts from the date due for payment until the date of actual payment. We reserve the right to apply any expense and/or costs or disbursements incurred by 7travel in recovering any outstanding monies including debt Collection agency fees and legal costs.
All amendments are subject to a minimum fee of $100 per person together with any additional amendment fees and conditions applied by the service providers.
Taxes, fees & other charges
Taxes, fees, additional levies and government charges may apply, and are beyond our control and may change at any time. Taxes and Fees charged and collected by the airline(s) are only confirmed once your ticket is issued. Australian departure tax is recorded on your ticket as being paid. There are still some countries where taxes are paid upon arrival and/or departure from the airport.
Acceptance of your booking is subject to each service provider's standard conditions of acceptance of guests including, but not limited to, conditions in relation to booking, occupancy, payment and checkout that apply at all times.
- To make a booking using your gift voucher please call 1300 297 577, you must quote a valid gift voucher identification number to be able to redeem for a holiday package

- Gift vouchers should be treated like cash, lost or stolen vouchers will not be replaced or refunded.
- Gift vouchers are for personal use, and not transferable.
- Gift Vouchers may not, be resold or offered for resale in any manner (including but not limited to via online auction or other unauthorised resale sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If a Gift Voucher is sold or used in breach of this condition, 7travel may in its absolute and sole discretion cancel or render invalid the Gift Voucher without a refund and the Gift Voucher holder may be refused redemption of the Gift Voucher. 7travel will take all reasonable steps to notify you of 7travel’s intention to cancel or render invalid a Gift Voucher within a reasonable time before cancelling or rendering invalid the Gift Voucher.
- Gift vouchers are not refundable after purchase, any amounts not used in 1 transaction will remain as a credit.
- Gift vouchers are only to be used against the published packages found at www.7travel.com.au
- Gift vouchers are valid for 3 years from date of purchase. Expired vouchers are non-refundable in whole or part. Once expired, vouchers are no longer valid and will not be honoured
- Existing gift vouchers or credits cannot in any circumstances be used to purchase gift vouchers in full or as part-payment
- Your Gift Voucher may only be used to make purchases up to the initial Gift Voucher value. If you wish to make a purchase for an amount that exceeds the Gift Voucher value or the Remaining Gift Voucher Value, you must pay the excess using another payment method.
- Where a trip paid using gift vouchers is cancelled, if any refund is due, will be refunded onto a new gift voucher.
- Gift Vouchers cannot be cancelled once they are issued except if voided by 7travel, if their value is used or if they expire.
- 7travel may cancel or render invalid any Gift Voucher (including any available balance) which 7travel determines in its absolute and sole discretion was purchased at any time and in any way (including via online auction or other unauthorised resale sites) by fraudulent means. 7travel may cancel any bookings made using any fraudulent Gift Voucher which may include any non-refundable amounts. 7travel will not be responsible for any costs incurred by you if you purchase or attempt to redeem any fraudulent Gift Voucher. You acknowledge and agree that you will not be entitled to redeem any available balance on any fraudulent Gift Voucher and that 7travel will not be obliged to hold such balance on file for you or otherwise redeem or exchange that Gift Voucher.
- Gift Vouchers may not be used for payment of credit or retailer accounts.
Some packages may include carry-on baggage only. Checked baggage may be available to purchase at an additional charge. Please contact us for details.
Airline Meals and Aircraft seating: Please contact us for all meal and aircraft seating requests. Please note that bulkhead seats are generally reserved for families travelling with infants. Exit row seating cannot be reserved by us and is only made available at check-in. Requests may not be guaranteed until check-in and is subject to availability and the airline conditions of carriage. Any special meals if available must also be requested at the time of booking.
Cruise itineraries may be varied by the cruise operator from time to time due to factors such as high or low water levels, flooding, lock closures, unscheduled vessel maintenance or for any other circumstances beyond our control.
Flights are provided by airlines. You are responsible for ensuring that you check-in on time and provide the correct travel documentation to exit Australia and enter the country, or countries, you are travelling to. We are not responsible for changes to airline scheduled departure times, departure dates or flight cancelations.
The airlines do have the right to reschedule or cancel flights at ANY time. Please note that the airlines accept no responsibility to accommodate any changes made that don't suit you. We will use our reasonable endeavours to assist you to rebook on the closest flight time or date available, subject to seat availability. We will not accept responsibility should changes occur nor do we accept responsibility for any additional cost incurred by you to make alterations to your booking to accommodate these changes as these are beyond our control.When requested we will add your Frequent Flyer number, and or/membership number(s) to your booking. Not all flights, fares and rates are eligible to earn points. We cannot accept any responsibility if the Supplier does not award you points for your booking.
Accommodation providers may require you to present photo ID when you check-in. It is also likely that they will request you provide a credit card, payment card or cash deposit when you check-in to cover any expenses you may have during your stay that are not included in your package.
In the event you do not arrive for the first night of your booking and plan to check-in for subsequent nights in your booking, you must confirm the booking changes no later than the date of the first night of the booking to prevent the cancellation of your entire booking. You are responsible for any cancellation or change fees that you incur.
In exceptional circumstances a hotel may need to move your booking to a different hotel. In the unlikely event that this happens, we reserve the right to provide you with an alternative hotel of a similar standard.
Many of the bonus inclusions which are incorporated into various packages have no associated costs charged to you the customer i.e. they are ‘free’ inclusions. This includes, but is not limited to, bonus inclusions such as cruises, golf, massages, day tours etc. Should you elect to cancel any component of your package there will be no refund forthcoming or any reduction in the overall package price. Additionally, should any ‘bonus’ inclusions be cancelled by an operator or any such service not be provided to you, no refund will be forthcoming nor will any additional service or compensation be provided unless offered directly to you by the service provider responsible for that service.
The Australian Government advises that all travellers obtain travel insurance prior to travel. The insurance should cover loss of deposit and other monies through cancellation, loss or damage to personal baggage and loss of money, medical expenses, additional expenses to cover hotel accommodation and repatriation costs to Australia should any services need to be extended or curtailed due to illness or other insurable risk. Our reservations team can provide you with general information about travel insurance at the time of booking. If you do not require travel insurance you agree to provide written acknowledgement that a recommendation to obtain travel insurance has been made to you by us.
Guests who are pregnant during a cruise are required to supply a physician’s ‘fit to travel’ note, including your estimated due date, prior to embarkation. The Cruise operators are unable to accept any guests who will have entered their 24th week or later of pregnancy, by the end of the cruise.
You are responsible to supply all passenger names exactly as they appear on your passports. If the spelling of any name itemised on a 7Travel booking confirmation is different to the name on that person's passport/photo identification - PLEASE ADVISE US IMMEDIATELY. Failure to provide your correct names may require a re-issue of tickets and other documentation and you accept responsibility for this cost. In some cases you may have to pay more for your ticket if there are no seats available to rebook in the same fare type as the original ticket. Any fees will be the responsibility of the passenger if 7Travel has not been informed of the correct name and spelling at the time of the initial booking. Please note that most airlines treat name changes and route and/or itinerary alterations as FULL CANCELLATION and can incur full cancellation charges.
Leaving a cruise early
If you are required, or choose, to leave the cruise for any reason (unless caused by our proven negligence or failure to provide services with due care and skill and that are reasonably fit for purpose), we are not responsible for any expenses, including your return home. This also applies if you do not return to the ship in time for sailing after a port visit. If we assist with any costs, you will need to repay us on your return. In addition, you will not be entitled to any refunds.
Your airline E-ticket will be sent to you no later than 30 days prior to your departure date. Travel Documents include (without limitation) airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider. Travel documents may be subject to certain conditions and/or restrictions including (without limitation) being non-refundable, non-date-changeable and subject to cancellation and/or amendment fees. All Travel Documents are non-transferable. 7Travel will not be held responsible for tickets and/or documentation lost by a third party. Any charges associated with re-issue and re-sending of tickets and/or documentation will be at your expense.
Passports are required by all passengers travelling internationally and are always the responsibility of the passenger. Most countries require that foreign nationals entering hold a passport with at least 6 months validity beyond the date of your return to Australia.
Visas and Vaccinations
Visa and health requirements are the responsibility of all individual travellers. Permanent residents travelling on a foreign passport must hold a valid returning resident Visa. The final responsibility for ensuring documentation is correct and current is that of the individual traveller.

Department of Foreign Affairs & Trade- Travel Warnings
7Travel makes no representations as to the safety, conditions and other issues that may exist at any destination. For reasons of political unrest, acts of war or terrorism or natural disasters in certain parts of the world the Australian Government in conjunction with various other worldwide bodies may decide to issue a Government Advisory Warning to Australian Passport holders not to travel to that country. In these instances, whilst travel to some countries is not advisable and some clauses of the travel insurance coverage may not be effective we appreciate that some travellers may still need to travel to those areas. Whilst we are prepared to make these bookings on your behalf we do so without responsibility or liability. Current travel warnings and other information is available on the Department of Foreign Affairs website at www.smartraveller.gov.au It is recommended that all Australian travellers register their personal details i.e. Passport numbers, contact details in Australia and the countries you will be visiting so that in case of emergency you can be contacted.
Changes and cancellation
Subject to any rights you may have under the Australian Consumer Law:
- if you have made a booking with us, and want to cancel or amend a booking or reservation, please contact us;
- many rates, fares and packages are non-refundable, and you must check the terms and conditions that apply before completing your booking.
Bookings made are made for the traveller, or travellers, whose names have been entered in the booking. Bookings may not be able to be transferred at all, or may incur costs.
We cannot guarantee that changes will be permitted by the Supplier. Some Suppliers will charge a fee for changes and/or cancellations. When changing a booking, the new price will be based on the rates and fares available on the day that you make the change. These prices may not be the same as when you originally booked. In addition to the Supplier’s fees we will charge you a fee for facilitating the change or cancellation.
Packages - Wherever possible, we will assist if you wish to cancel or change a component of a package, however, this will mean that your booking is no longer to be considered a package. Because of this, some of the benefits previously included may not apply, including but not limited to savings made from purchasing the components together as a package. If a Supplier cancels a component of a package, we may elect to either cancel that package in whole, or substitute a substantially similar element for the cancelled element. We are not liable for the cancellation of a component by a Supplier or the consequences of that cancellation.

Intellectual property rights
All intellectual property rights (IP) in this website, including design, text, graphics and software relating to our Service belong to, or are licensed by us. These intellectual property rights are protected by Australian and international laws. You may not copy, adapt or reproduce any part of this website without our prior written permission or, in the case of third party material, prior written permission from the owner of the intellectual property rights in that material.
You acknowledge that the 7Travel trademark is owned by Seven Network (Operations) Limited. You may not remove, alter or modify any identifying mark, copyright, or other proprietary notice of Seven or its licensors from the Service.
You grant us a non-exclusive, irrevocable, worldwide licence to use any intellectual property rights in any material that you provide to us (including where that material is owned by a third party). You warrant that you are entitled to grant this licence and that doing so will not breach the rights of any third party.
Ignite Holidays Pty Ltd (Licence No. TA3633047) (“Ignite”)
By submitting your inquiry and/ or making a booking, you acknowledge, consent and agree that the supplier of your travel products or packages may be an overseas entity, and may not be accountable under the Privacy Act and you may not be able to seek redress under the Privacy Act with respect to their handling of your personal information.
Seven may also disclose your personal information to related entities, business partners and external service providers for research and profiling purposes as well as other purposes reasonably related to your relationship with Seven.
In addition, by logging in to access the 7Travel Service, and/ or where you submit an inquiry or make a booking regarding products or services available via the 7Travel Service, you consent to Seven using your personal information for the purpose of Seven and its related entities sending you information regarding programs, products and services available through them and/ or through their business partners. We will always provide you with the ability to opt out of those communications.
You also agree that we may use proprietary measurement software in the 7Travel Service which will allow users to contribute to market research or audience ratings services.
Links to External Web Sites
This website may contain links to other websites. The links are provided for your convenience and may not remain current or be maintained. We do not accept any responsible for the content or privacy practices associated with linked websites.
The 7Travel Service does not include every travel product that is available.
The airlines, hotels, other Suppliers and our subcontractors are independent parties and not our agents or employees. To the maximum extent permitted by law neither we, nor our Suppliers, nor our subcontractors make any representation about the suitability of the information, software, products and services.
Liability and indemnity
To the maximum extent permitted by law, neither we nor any of our Suppliers or subcontractors are liable for any loss or damage, however caused (including, but not limited to, by our negligence) suffered by you in connection with these terms or your use of our 7Travel Service.
If the Competition and Consumer Act 2010 (Cth) or any other legislation states that there is a guarantee in respect of goods or services supplied, and the liability for breach of that guarantee may not be excluded but may be limited, our liability and the liability of any of our Suppliers and subcontractors for such breach is limited to:
- the replacement of the product or the supply of an equivalent product;
- the payment of the cost of replacing the products or acquiring equivalent products;
- the supply of the services again;
- the payment of the cost of having the services supplied again.
Except as set out above and to the maximum extent permitted by law, our liability and the liability of our Suppliers and subcontractors in connection with these Terms, is limited to $100 each.
We will not be in breach of these Terms, as a result of, or liable for, any failure or delay in the performance of its obligations under these Terms to the extent that such a failure or delay is wholly or partially caused, directly or indirectly, by any occurrence or omission outside our reasonable control.
The information on the 7Travel Service is provided for general informational purposes. Neither we nor any of our Suppliers or subcontractors make any warranties to its completeness, accuracy or fitness for a particular purpose in relation to this information.
Neither we nor any of our Suppliers or subcontractors are liable to you for any consequence of any action, loss or damage, however caused, which may be directly or indirectly suffered, in connection with use of any the information contained on, or accessible through the 7Travel Service. This includes, but is not limited to, re-routing or an increase in pricing due to rate or fare increases caused by a technical error, because availability has changed or when the rate or fare has been removed from sale.
You agree to indemnify each of us, our Suppliers and our subcontractors for all damages, losses, expenses and costs, including legal costs, that arise from your breach of these Terms, and with respect to any death or personal injury you may suffer or cause in connection with the travel you undertake pursuant to bookings made via the 7Travel Service.
Limitation of Liability
We do not accept any liability, whether in contract, tort or otherwise, for any act or omission of travel service providers including their failure to provide a service whether through their negligence or otherwise. We do not make any representation about the standard of the services to be provided by travel service providers, and we accept no liability in that regard. We do not accept any liability, whether in contract, tort or otherwise, for any injury, losses, expenses, delays or inconvenience suffered by you in connection with your booking or your travel services, unless our liability is prescribed by legislation which cannot be excluded. Without limiting the foregoing, we will not be liable for any loss of benefit or change in status relating to any loyalty, rewards, frequent flyer or other program which result from the actions of a travel service provider, including a change in flights or a change in airline carrier. Where our liability cannot be excluded, our liability is limited to the amount that you have paid for your travel services.
If you, acting reasonably, cancel your holiday as a result of a travel warning issued for your travel destination by the Australian government, we will refund to you any amount which you have paid to us and which we have not already paid (or are not legally obliged to pay) on your behalf to service providers. In that case, you agree that we shall be entitled to retain a booking fee applicable to your booking (a minimum of $200 per person) which is a reasonable remuneration for the services that we have provided and is a reasonable estimate of the expenses incurred by us in advertising, facilitating and booking your holiday.
7travel offers a range of travel services (such as flights and accommodation) on behalf of others who provide those services (such as airlines and resorts facilitated by Ignite Holidays Pty Ltd on our behalf). Our duties to you are limited to arranging bookings on your behalf with those service providers. We are not responsible for providing those services to you. If a service provider fails to provide you with a travel service, you agree that your only rights are directly against the service provider and not against us. You agree that we are not liable to you for any losses that you suffer in those circumstances, and that you will not claim against us (directly or indirectly), nor our travel fulfilment provider, any refund, credit or other dispute. You agree that any money that you have paid to us, has been paid to us for the purposes of us forwarding payment on your behalf to the service providers to secure the booking for your travel services. If you have paid any amount to us by credit card, you agree that you will not lodge any dispute with your credit card issuer about the validity of your credit card transaction with us where a service provider fails to provide a service to you for any reason.
7travel acts as an agent only. We offer a range of travel services (which may include but are not limited to flights, accommodation, cruise liner services, coach and rail services) on behalf of others who provide those services. Our duties to you are limited to arranging bookings on your behalf with those service providers. We are not responsible for providing those services to you, or for the standard of any service provided. If a service provider fails to provide you with a service, or you are not satisfied with the standard of any service provided, you agree that your only rights are directly against the service provider and not against us, nor our travel fulfilment provider. You agree that neither we nor our travel fulfilment provider are liable to you for any losses that you suffer in those circumstances, and that you will not claim against us (directly or indirectly) any refund, credit or other compensation. You agree that any money that you have paid to us will not be held on trust for you, but will be used by us to make payment to the service providers to secure the booking for your travel services.
We may subcontract the performance of all or any part of our obligations under these Terms to our service providers such as Ignite Holidays Pty Ltd
who will handle your booking, itinerary and payment processing for us.
You must not subcontract the performance of all or any part of your obligations under these Terms without our prior written consent.
Applicable Laws and Severability
Neither we nor any of our Suppliers or subcontractors make any representation that the information provided is appropriate or available for use in other locations, or accessible from territories where the content is illegal or prohibited. If you access our 7Travel Service from other locations, you are responsible for compliance with applicable local laws. Any claim shall be governed by the laws of New South Wales and you accept the exclusive jurisdiction of the courts of New South Wales.
If any part of these Terms is held unenforceable by a court of competent jurisdiction, the remaining parts of these Terms will remain in full force and effect.
From time to time we may make amendments to these Terms. We will notify you about such amendments by posting an updated version on the website.
Feedback and Complaints
We welcome your feedback, both positive and negative. If you are unhappy with our 7Travel Service, please contact us. We will try to settle any complaints or concerns you have quickly and fairly.
In these Terms, a reference to includes or similar words means includes but without limitation.

4.3 In conjunction with clause 4.2, prize winners must abide by the following conditions:
a) Winners and their companions must be able to travel before 30 November 2020 or prize is forfeited. Specific travel dates and arrangements are subject to air travel, holiday, blackout dates, and other prize and travel restrictions.
b) Trip must be booked at least ten (10) days in advance of intended departure date.
c) Winner and their companions must hold eligible passport/all relevant visas.
4.4 In accepting the prize, the winners consent to participate in and co-operate with all reasonable media editorial requests, including but not limited to, being interviewed and photographed, and the winners grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use.
4.4 The winner agrees s/he will not sell or otherwise provide their story and/or photographs to any media or other organisation.
4.5 Prizes detailed in clause 4.2 are not exchangeable, transferable or redeemable for cash and subject to the further terms and conditions below at 4.17 to 4.19.
If Winner elects to partake in any or all portions of his/her Prize without a Guest, the Prize will be awarded to Winner and any remainder of the Prize will be forfeited and shall not be subject to further or alternative compensation. All elements of the Prize must be redeemed at the same time, and no changes will be permitted after confirmation of any redemption.
4.6 Winners may only take a minor as a companion if they are the minor’s parent or legal guardian.
4.7 Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

4.9 Prize does not include any other item or expense not specifically described in these Terms and Conditions, and all additional expenses, if any, are the sole responsibility of the Winner. Prize may not be transferred or assigned except by the Promoter. Only the listed Prize will be awarded and no substitutions or cash equivalents or redemption will be made, except that the Promoter reserves the right to award a Prize of equal or greater value if any advertised Prize (or any component thereof) becomes unavailable, subject to legislative approval. Prize cannot be used in conjunction with any other promotion or offer.
4.10 The Prize is subject to booking, availability and any terms and conditions imposed by the relevant providers. Blackout dates will apply in accordance with the resorts peak booking periods. Winner and any travelling companion(s) must depart and return at the same time using the same air carrier. Winner and any travelling companion(s) are responsible for ensuring they have all necessary travel insurance (if not included in the Prize) and documents to travel to the relevant place(s) (including passports and visas, if required). Any alterations or extensions to Prize details must be approved in advance by the Promoter (at its sole discretion) and will be at the expense of Winner. The Promoter is not responsible for the cancellation, delay or rescheduling of any part of a travel or accommodation component of Prize and any costs incurred by Winner or any travelling companion(s) as a result (including accommodation costs) will be the responsibility of the Winner. Winner is responsible for ensuring that they and their travelling companion(s) are fit to travel and have received appropriate immunizations and/or health checks prior to taking the Prize.
4.11 Unless expressly stated in these terms and conditions all other expenses related to the Prize become the responsibility of the Prize Winner and their nominated companions. All costs associated with the Prize which are not expressly stated in these Terms and Conditions to be included, including but not limited to ground transportation, meals, gratuities, incidental hotel expenses additional to spending money, passport and visa costs, transfer costs, insurance, luggage costs and all other ancillary costs, are the responsibility of the Winner.
4.12 No compensation or alternative travel plans will be arranged should the Prize winner and/ or their companion/s miss their outbound or return flights or fail to meet any check in requirements for any reason. These costs will be the responsibility and expense of the prize winner and companion/s. The Promoter is not responsible for any costs associated with flights that are cancelled or delayed for any reason, including but not limited to accommodation and transfer costs. The Promoter is not responsible if cancellation or delay of flights causes the prize winner and companion/s to miss the ticketed performance that makes up part of this prize.
4.13 A credit card imprint may be required from the prize winner at check-in to the hotel for all incidental charges.
4.14 Once booking is confirmed no changes are allowed, unless otherwise authorised by the Promoter in its absolute discretion and if permitted will incur change fees which will also include supplier charges payable by the prize winner.
4.15 The prize winner must provide valid identification to the Promoter.
4.16 The Promoter may amend these terms and conditions, as is reasonably necessary, in its absolute discretion.

5. HOW TO WIN
5.1 The winner will be the first valid entry drawn using an approved electronic drawing system on 6 November 2019 at 10:00am AEDT.
5.2 The draw will take place at and be conducted by Ansible Pty Ltd, Level 3, 100 Chalmers Street, Surry Hills NSW 2010.
5.3 Winner will be notified by phone or email by the Promoter within 2 days of the draw, and published on the competition page on the 7travel website.
5.4 The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result.
5.5 It is a condition of accepting the prize that the winner (and any companions) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
5.6 The Promoter may in its absolute discretion deem entries invalid subsequently to a winner being notified or a winner’s name being announced if it is discovered that the winner did not enter the Competition in accordance with these terms and conditions.

6. NO LIABILITY
6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to state government legislation.
6.2 Seven Network (Operations) Limited, and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
6.3 Seven Network (Operations) Limited, and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
a) during the entry process or the draw;
b) in the acceptance, participation or use of any element(s) of the prize;
c) as a consequence of late, lost or misdirected mail;
d) due to the broadcast of any program relating to the Competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
e) in relation to failure of an SMS entry message to be received by the Promoter on account of technical problems or traffic congestion; or
f) arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this promotion.
6.4 Seven Network (Operations) Limited assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available, subject to state government legislation.
6.5 If for any reason the Competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to state government legislation.
6.6 By entering the competition, and by collecting a prize, the winner acknowledges and accepts that driving, travel and any other activities comprising the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. Neither the Promoter nor the Sponsor are responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst the winner is travelling. It is the responsibility of the prize-winner to enquire about local issues and conditions at destinations prior to travel.
